Divorce can be a stressful and draining process, especially when children are involved. Our expert divorce lawyers can make this process quick, easy, and stress-free. From 6th April 2022, a new law saw changes to the ‘reason of divorce’. Now you do not need to rely solely on facts to prove that a marriage has irretrievably broken down. You can also mutually file a divorce if you think your relationship is over. Whichever route you and your spouse need to take, we’ll ensure all decisions are made with your best interests in mind. Applying for a divorce

You can apply for a divorce if:
  • You have been married for at least one year
  • Your marriage is recognised in the UK
  • Your marriage has broken down
  • Both of you or one of you is habitually resident in the UK
The process usually takes around 6 months.
  • You need to decide if you are applying as a sole applicant or jointly (you can make a joint application if you are not at risk of abuse)
  • If you started as a joint application and your husband or wife stops responding, you can carry on the application as a sole applicant
  • You can also make a sole application if your spouse does not agree that you should get a divorce
If you have applied jointly:
  • You will be sent a notice that your application is being processed with a copy of your application stamped by His Majesty’s courts and tribunals service, an acknowledgement receipt and a case number.
If you applied as a sole participant:
  • You will receive the above not including the acknowledgement receipt
  • The court will send an acknowledgement of service form to the other party
  • They will have 14 days to respond
If the judge agrees, the court will send you and your husband or wife a certificate. The certificate will tell you the date and time you will be granted a condition order (decree nisi). Please also be aware:
  • You will have to wait 6 weeks and one day before you can apply to finalise your divorce
  • You can apply for a final order as a sole applicant even if you started the process jointly
  • You will be told how to do this online or by post by filling out an application for the final order
  • They will need to complete an answer form
  • They must have a genuine legal reason to dispute the divorce
  • If they do not submit the form, you can continue the divorce by applying for a condition order or decree Nisi if your application was issued before 6 April 2022
  • The court will check that time limits have been met and there are no reasons not to grant the divorce
  • The court will send you both copies of the final order
  • One you receive this, you are divorced, no longer married, and free to marry again if you wish
  • Our fixed fee for a non-disputed divorce application is £500, plus VAT
  • The courts’ fee for a divorce application is £593
  • The court’s fee can be exempted if you are on a low income or receive public benefits
